1.1. In these Terms & Conditions the following definitions apply:
1.2. Unless the context requires otherwise, references to the singular include the plural and references to the masculine include the feminine and vice versa.
1.3. The headings contained in these Terms of Use are for convenience only and do not affect their interpretation.
2.1. This Website is owned, managed and maintained by Access Job Boards Ltd, where Access-ScienceJobs.co.uk is the trading name. It is made available to you based on the Terms of Use set below, and by using the Website you accept these Terms & Conditions.
2.2. Access complies with the provisions of the Data Protection Act 1998, with regards to the handling of and respect of any Jobseeker information received and will endeavour to keep such information confidential unless requested to do otherwise.
2.3. All copyright, database rights and any other intellectual property rights including material provided on the Website are owned by Access Job Boards Ltd or its third party suppliers.
2.4. Access does not act or have any relationship as an Employment Agency or business, to provide Employment services on behalf of any Recruiter, Jobseeker or any other user of the Website.
2.5. Services to Recruiters will only commence once a completed service agreement has been returned within 7 days of the date issued. When this has been approved, a username and password will be issued to the registered recruiter, and the services agreed will commence.
2.6. Recruiters are obliged to keep their registered password confidential, and to not disclose to any other person outside of their organisation. Any misuse of the Website under their password will be the responsibility of the registered Recruiter. If Access has reason to believe that a password has been used by an unauthorised person, restrictions may be placed on that password.
2.7. Recruiters must act in a fair and professional manner when contacting and dealing with Jobseekers obtained through the Website, in order to avoid bringing Access into disrepute.
2.8. The Recruiter will indemnify any claim inclusive of legal costs commenced by a Jobseekeragainst Access which has arisen from a breach of these Terms of Use by the Recruiter.
3.1. Recruiters are responsible for entering all their own lineage Advertisements online through the Website, unless otherwise stated a vacancy template can be emailed to Accessto be entered.
3.2. The Recruiter will reply to the job applicant in a timely and professional manner, and is responsible for any further contact during the recruitment process.
3.3. All Advertisements should be legal, decent and truthful and comply with all applicable advertising laws, rules and regulations.
3.4. No lineage Advertisement should contain any artwork, logo or design work.
3.5. Any lineage Advertisement containing offensive, obscene or indecent language will be removed from the Website.
3.6. Access may edit or remove any advert which fails to comply with legal or moral obligations, at the discretion on Access.
3.7. The Recruiter may edit, delete or re-post any of their jobs at any time within a standard or premium subscription period, by using their online registration details through the Website.
3.8. For the use of Access' own advertising and marketing purposes, the Recruiters' vacancy may be used in support of an advertisement in outside publications, unless the Recruiter has requested otherwise.
4.1. This service is available to all Recruiterswho have a premium subscription, they are then able to download unlimited Jobseeker CV's via the Website.
4.2. As a Recruiter, you only have access to the database and should be aware that all database rights are owned by Access Job Boards Ltd. Recruitersshould acknowledge that they do not acquire any rights to the database or its content, and its use is governed by these Terms & Conditions.
4.3. Recruiters must only use information from the candidate database for their recruitment activities, and the information should not be supplied or sold to any person or organisation outside of the Recruiter's company.
4.4. The Recruiter must adhere and abide with the Data Protection Act 1998 when handling information regarding candidate's details.
5.1. If requested in the service agreement, Recruiters may have a banner advert on the Website homepage. This should be recognised by the Recruiter as a company branding service, and in no way should be confused with specific vacancy advertising.
5.2. A logo button will be displayed in no particular order on the homepage and will link to the Recruiters' details. The logo will be displayed for as long as stated in the service agreement.
6.1. If requested in the service agreement, Recruitersmay have a banner advert displayed on the Jobs-by-Email page distributed to all registered Jobseekers who have requested this service.
6.2. This will be displayed as a logo button with the Recruiter's chosen text and links back to the Recruiter's details.
6.3. There is no guarantee of the availability of this service, and it is at the discretion of Access to display the logo on a rotational basis.
7.1. The rates for services will be at the discretion between Accessand the Recruiterand will be agreed prior to issuing a service agreement. All prices exclude VAT.
7.2. Access will invoice in respect of the fees to the invoice contact detailed on the service agreement. The Recruiter agrees to pay the full invoice amount within 14 days.
7.3. If the Recruiter fails to pay any amount owing after the invoice due date, Access reserve the right to suspend provision of services and to charge interest on the amount owed at the rate of 4% above Nat West Bank Plc's base rate.
8.1. Either Access or the Recruiter may, at their discretion, terminate the contract at any time by notice in writing to the other party.
8.2. If the Recruiter cancels their order at any time within the dates specified in the service agreement, they will remain liable for any outstanding payment owed.
8.3. Access has the right to cancel or suspend the Recruiter's services if the Recruiter is in breach of the contract, and fails to remedy such a breach within 7 days of notice from Access.
9.1. The Recruiter agrees to keep Access fully and effectively indemnified against any liability and without limitation involving all losses, costs, claims, expenses, demands, actions, damages, legal and other professional fees, which Access may suffer or incur as a result of any breach of any Recruiters obligations in respect of these Terms & Conditions.
10.1. Access hold no responsibility for any loss, delay, damage or costs howsoever caused through the use of the Website.
10.2. It is the liability of the Recruiter to provide adequate and accurate information on any of the Advertisements they have on the Website.
11.1. These Terms of Use are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the courts of England & Wales.
